Description: The U visa program is a powerful tool for undocumented victims of domestic violence and sexual assault. It provides a pathway to legal permanent residency and potentially U.S. citizenship for immigrants who cooperate in the investigation or prosecution of their abusers. But the program isn’t working. Why? Because, for all intents and purposes, the U.S. Department of Homeland Security has stopped processing U visa applications, leading to delays of many years just for U visa petitioners to receive a response to their applications. While they wait, these victims remain subject to potential deportation and lack authorization to work legally in the U.S. How can we help them? By filing unreasonable delay claims seeking redress under the Administrative Procedure Act and the Mandamus Act! The LBA is partnering with the Pennsylvania Immigration Resource Center to match volunteer attorneys willing to help file litigation on behalf of U visa petitioners who have been waiting for more than three years for a response from the government. This CLE will provide background information regarding the U visa program, the Administrative Procedure Act, and the Mandamus Act. We will provide attendees with the basic information needed to know when filing these types of cases.
This CLE is open to all, but the LBA will waive the attendance fee for those who volunteer to provide potential pro bono service to a PIRC client.
